01Who we are
This website is operated by Daniel Amezcua Photography ("we", "us"), an independent photography and web design studio in Salt Lake City, Utah. It is part of the AME7CUA Creative Studio. This policy explains what personal information we collect through danielamezcua.com and our client booking and gallery tools, how we use it, and the choices you have.
02Information we collect
We do not use analytics, advertising or social-media tracking tools on this site at the time of writing. Please do not include sensitive information (such as health details) in the public contact form; use the questionnaire we send or tell us in person.
- Inquiry and contact form: your name, email address, the service you are asking about, your budget range and how you heard about us (if you choose to say), and your message.
- Booking: your name, email, phone number (optional), the session type and time you choose, and any notes you add.
- Client records: if you become a client we keep your name, contact details, session notes and history, contracts and the name and date you signed with, invoices and payment records, and the emails we send you through our system.
- Questionnaires: the answers you give in the pre-session questionnaires we send you, which can include personal preferences, wardrobe and comfort notes, and, for some sessions, sensitive details you choose to share.
- Private galleries: when you open a gallery we may record your email address or name (where the gallery asks for it), the photos you mark as favorites, download activity, and a random visitor identifier. Invite-only galleries are tied to the email address that was invited.
- Photographs: the images we create at your session, including intimate or boudoir images where that is the session you booked, and the edited versions we deliver.
- Technical data: our hosting provider processes standard server logs (such as IP address, browser type, pages requested and time) to deliver and secure the site.
- Your cookie choice: saved in your browser's local storage on your device (see our Cookie Policy).
03How we use it
- To reply to your inquiry, schedule and run your session, and deliver your photographs.
- To prepare contracts and invoices, take payment by the methods we give you, and keep business records.
- To send reminders, gallery links, access codes and other messages about your booking or gallery.
- To send a studio announcement or newsletter, if you asked for one. You can unsubscribe at any time.
- To keep the site secure and prevent spam and abuse (for example, limiting repeat form submissions).
- To meet legal, tax and accounting obligations.
04Photographs and your privacy
Your images are personal. We store session photographs in private galleries that are not searchable and are available only to people who have the link and, where required, the password or personal access code. Images of a private, boudoir or intimate nature are never published, sold, shared or used for marketing without your separate written consent, which you can give or decline for each image or set. Any public portfolio use of other images is governed by your signed agreement or model release, and you can ask to opt out as described there.
05Who we share it with
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We use service providers that process information on our behalf and only for our purposes:
- Convex, which hosts the database for forms, bookings, client records, contracts, invoices and galleries.
- Bunny.net, which stores and delivers gallery photographs and site media through its content delivery network.
- Resend, which delivers the emails we send you.
- ClickUp, which we use to track client projects and bookings internally.
- Netlify, which hosts the website and keeps a copy of contact form submissions.
- Pixieset, where some existing clients still receive and download galleries under Pixieset's own terms and privacy policy.
- Payment apps you choose to pay with (such as Venmo or PayPal), which handle your payment under their own policies. We do not process card payments on this site or store card numbers.
06Retention
We keep inquiry information for as long as needed to respond and to carry on a relationship with you if one begins. Client records, signed agreements, invoices and payment records are kept as long as required for tax, accounting and legal purposes. Galleries can be set to expire, and we remove or archive them when they are no longer needed. We do not keep a fixed retention period for session photographs; you can ask us at any time to delete your images and records, subject to anything we must keep by law.
07Your choices and rights
Depending on where you live (for example California, Colorado, Utah, Virginia, Connecticut or the European Economic Area and United Kingdom), you may have the right to know what personal information we hold about you, to access or correct it, to delete it, to receive a copy, to opt out of sale, sharing or targeted advertising (we do none of these), and to withdraw consent. We will not discriminate against you for exercising these rights.
To make a request, email us at the address below from the address you used with us. We may need to verify your identity before acting. If we deny a request you can ask us to reconsider, and you may also contact your state attorney general or local data protection authority.
We honor the Global Privacy Control browser signal as an opt-out of non-essential tracking, and you can change your cookie choice at any time with "Your Privacy Choices" in the footer.
08Children
Our sessions and this site are for adults. Boudoir and intimate sessions are available only to people aged 18 or older, and we do not knowingly collect personal information from children under 16 through this site. For a session with a minor (for example a modeling or performance shoot), a parent or legal guardian must make the booking and sign the paperwork. If you believe a child has sent us information, contact us and we will delete it.
09Security and transfers
We use reasonable technical and organizational measures to protect information, including access-controlled private galleries and signed-in access to client records, but no method of transmission or storage is completely secure. Our service providers may process information in the United States and other countries.
10Changes to this policy
We may update this policy. The date at the top shows when it last changed. Material changes will be noted on this page.
