Terms of Use

By using danielamezcua.com (the "Site") you agree to these terms. If you do not agree, please do not use the Site. The Site is operated by Daniel Amezcua Photography ("we", "us") in Salt Lake City, Utah, as part of the AME7CUA Creative Studio.

The Site describes our photography and web design services, shows examples of our work, and lets you inquire, book and view galleries. Information on the Site, including prices and "from" amounts, is general and is not a binding quote or offer. A session or project is governed by the written agreement, proposal or invoice we both sign or approve. Sending an inquiry does not create a client relationship or obligate either of us.

Booking details, deposits, rescheduling and cancellation are set out in your session agreement and invoice, which control if they differ from the Site. We accept payment by the methods stated on your invoice. We do not sell prints or process card payments through this Site.

The Site's design, text, code, logo and all photographs, video and imagery are owned by Daniel Amezcua or used with permission, and are protected by copyright and other laws. You may view the Site and share links to it. You may not copy, reproduce, scrape, modify, distribute or use our images, text or designs for any other purpose, including training AI models, without our prior written permission.

Photographs delivered to a client are licensed to that client as stated in the session agreement. Unless the agreement says otherwise, the license is for personal, non-commercial use, and commercial use needs a separate written license.

Names, logos, screenshots and brands of the businesses shown in our web design work belong to their respective owners. They appear to describe our work and do not imply endorsement by, or affiliation with, any of them beyond the project described.

• Private galleries are for the person or people they were shared with. Do not share your link, password or personal access code, and do not post a gallery publicly.
• Invite-only galleries are tied to the email address that was invited. We may revoke or reset access at any time, for example if a link is shared.
• Galleries may expire. Download your images before the expiry date shown to you.

• Do not use the Site unlawfully, to send spam, or to submit false or harmful content.
• Do not attempt to disrupt, probe or gain unauthorized access to the Site or its systems, or to view galleries you were not given access to.
• Do not use automated means to submit forms or collect data, other than ordinary search-engine and similar crawling that follows our robots.txt.

The Site links to websites we do not control, including client sites, Pixieset, Instagram and our agency site AME7CUA. We are not responsible for their content or practices, and their own terms and privacy policies apply.

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any search ranking, traffic, sales or other results from our services or from information on the Site.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Site. Nothing in these terms limits liability that cannot be limited by law.

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Courts located in Salt Lake County, Utah have jurisdiction over disputes about the Site, except where the law of your place of residence requires otherwise.
